Should I Settle My Mesothelioma Lawsuit?

 
One of the hardest decisions that many mesothelioma cancer sufferers have to face is whether or not they should consider settling their mesothelioma lawsuit. Obviously, in an ideal world, most people would tell you not to settle and to make the people who caused this pain and suffering to experience the pain and hurt of having to go to trial and pay you your rightful compensation. Unfortunately, this is not an ideal world. Today, due to the longevity that it can take for this illness to show itself, many sufferers are not young. Add to this the fact that many sufferers need to undergo radical treatment, such as surgery, radiotherapy or chemotherapy, and it is not difficult to see how they’ll need constant, round-the-clock (read expensive) medical care. As a practical matter then, many mesothelioma cancer patients may well need to consider settling their lawsuit. However, before you get pushed into this situation, keep in mind the following:

First, there is absolutely nothing wrong with settling your mesothelioma lawsuit. Today, a number of mesothelioma cancer patients have gone to court and a rough compensation amount is now known. If you know that your settlement can be for an amount that is close to the amount you would have otherwise got had you gone to court, you should certainly be thinking about this option.

Second, before you can make any decision as to whether or not you should be settling your mesothelioma lawsuit you need to seek the advice of your lawyer to determine whether or not they consider this a sensible option.

Third, you should talk this through with your medical practitioner. Unfortunately, any form of cancer treatment is expensive. With the manner in which mesothelioma cancer is contracted, likely via exposure to asbestos in the work place, many suffers of this dreadful disease are manual labourer employees who do not have extensive available funds to treat the illness in any event. Consequently, long term litigation may not be in your best interests. Indeed, you may find that prolonging your settlement may be detrimental to the care and assistance that you could be getting today.

Fourthly, mesothelioma cancer can take up to 40 years to materialize in patients. After such a long period, many suffers are in the later part of their lives and will need constant home help assistance during the period they undergo treatment. It may, not, therefore, be in your best interests to fight a case waiting for compensation that, in all chances, won’t be forthcoming until after all of the above steps have been completed.

None of the above should be interpreted as saying that a mesothelioma cancer patient should quickly settle any case they have just to survive the here and now. What the above is intended to show is that a lot of thought may well be needed before discarding a settlement offer that may be close to the eventual compensation you would get through the courts in any event.
